The “Buy American Act” was originally passed by Congress in 1933, and signed into law by President Roosevelt. In 2009, Congress passed the 2009 stimulus bill entitled, the American Recovery and Reinvestment Act (AARA). The AARA was signed into law on February 17, 2009, by President Obama. Incorporated into the AARA were the provisions of the Buy American Act, which provided specific regulations whereby Federal Grant Funding, provided to State and Local agencies, must follow the guidelines in the Buy American Act. A review of the provisions indicates that AARA funding, used for school modernization and repair, must comply with the Buy American Act. The AARA allocated a total of $100 Billion for education, all of which has been provided to the various State and Local Agencies for distribution to the various qualifying school districts. Compliance by the State Executive Branch Agencies is a requirement, which include the Departments of Public Institutions and the Departments of Education.
Section 1605(a) of the Recovery Act directs that, “subject to certain exceptions, no funds appropriated or otherwise made available for a project may be used for the construction, alteration or repair of a public building unless the manufactured goods are produced in the United States”. The Recovery Act has provisions that may subject violators of the Buy American Act standards to severe consequences, including contract or project termination and False Claims Act liability.
